Terms of Service

1. Agreement
By accessing phynix.dev or using the Phynix client portal, you agree to these terms. If you do not agree, do not use the site or services.
2. Services
Phynix Solutions Pty Ltd ("Phynix") provides custom software development, AI integration, process automation, and operational diagnostics services. Specific deliverables, timelines, and fees are defined in individual project agreements between Phynix and the client.
3. Client Portal
Access to the client portal requires authentication via WorkOS. You are responsible for maintaining the security of your account credentials. Portal access is granted on a per-organisation basis and may be revoked at any time.
- Do not share portal credentials with unauthorised parties
- Notify us immediately of any unauthorised access
- Portal content is confidential and intended only for authorised users
4. Intellectual Property
Unless otherwise agreed in a project agreement: (a) Phynix retains ownership of all proprietary tools, frameworks, and methodologies; (b) the client receives a perpetual, non-exclusive licence to use the delivered software; (c) all website content, branding, and design on phynix.dev remains the property of Phynix Solutions Pty Ltd.
5. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information disclosed during the engagement. This obligation survives termination of the agreement.
6. Limitation of Liability
To the maximum extent permitted by Australian law, Phynix's total liability for any claim arising from or related to these terms or our services shall not exceed the fees paid by you in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
7. Termination
Either party may terminate a service engagement as outlined in the applicable project agreement. We reserve the right to suspend or terminate portal access for breach of these terms.
8. Governing Law
These terms are governed by the laws of Western Australia. Any disputes shall be resolved in the courts of Western Australia.
9. Changes
We may update these terms from time to time. Continued use of the site or portal after changes constitutes acceptance of the updated terms.
